1. Introduction

These Terms of Service ("Terms") govern your access to and use of the FPSHEAVEN website and consulting services ("Services"). By booking or using our Services, you confirm that you have read, understood, and agree to these Terms.

2. Our Services

FPSHEAVEN is a PC performance consulting and education service. Through scheduled one-on-one video consultation sessions, we provide advice and guidance on optimizing personal computer performance, including operating system configuration, driver optimization, network settings, and system configuration within manufacturer-supported specifications.

Our role is advisory and educational. We explain and recommend changes; you remain in control of your computer and decide whether to apply each recommendation. We do not guarantee a specific FPS increase, benchmark result, latency result, or outcome, because results depend on your hardware, software, drivers, cooling, power delivery, game updates, and other factors outside our control.

3. Booking and Payment

Consultations are booked through our scheduling page. Payment is required at the time of booking in order to confirm your appointment. Prices are shown per package before checkout and are payable in the currency displayed.

4. EU Consumer Right of Withdrawal

If you are a consumer located in the European Union, you have a statutory right to withdraw from a distance service contract within 14 days from the date the contract is concluded, without giving any reason.

You may ask FPSHEAVEN to begin providing the service before the end of the 14-day withdrawal period. If you make that request, you expressly request immediate performance of the service.

If the service is fully performed with your prior express consent, you acknowledge that you lose your right of withdrawal once the service has been fully performed. Completed consultations are non-refundable except where required by law.

If you withdraw after requesting that we begin providing the service during the withdrawal period, but before the service has been fully performed, you must pay a proportionate amount for the service already provided up to the time you inform us of your decision to withdraw. Any remaining balance will be refunded to your original payment method.

To exercise the right of withdrawal, email us at info@fpsheaven.com with a clear statement that you wish to withdraw.

5. Required Checkout Consent

Where required by law, before we begin providing a consultation during the 14-day withdrawal period, you may be asked to confirm the following:

"I expressly request FPSHEAVEN to begin providing the service before the end of the 14-day withdrawal period, and I understand that I lose my right of withdrawal once the service has been fully completed."

6. Cancellations and Refunds

Cancellations, rescheduling, missed appointments, and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms and applies alongside your statutory rights.

7. Support Coverage and Limitations

Each package includes a support period that begins when the service is completed. The length depends on the package purchased and is stated on the relevant package page. During this period you can reach us by email or support ticket.

Our recommendations are designed to stay within manufacturer-rated limits and to avoid reckless changes. However, computer stability depends on many factors we do not control, including hardware condition, firmware, drivers, Windows updates, cooling, power delivery, peripherals, and user changes. Stress testing may reveal pre-existing instability. We will explain each recommendation and help troubleshoot issues that arise within your support period. We are not responsible for defects in your hardware, third-party software, manufacturer updates, or changes made after the consultation.

8. Your Responsibilities

You are responsible for backing up important data before making system changes and for maintaining your configuration after the consultation. If you change your BIOS, Windows installation, drivers, hardware, or the settings discussed during the session, a fee may apply to review or re-do the configuration. If you experience an issue after a session, please contact us first before making further changes.

9. Hardware Suitability

We may decline or cancel an order where the hardware does not meet our criteria, where the request is outside our service scope, or where a meaningful improvement is not achievable on the described system. If we decline or cancel before the consultation begins, we will refund the full amount you paid.

10. Operating System and Software

We do not install third-party or unofficial custom operating systems. We work only with official Microsoft Windows installations and recommend installing a fresh copy directly from Microsoft's official website. Any optional tool we may suggest is explained to you beforehand, is intended to be reversible, and is not used to permanently disable security updates.

11. Third-Party Changes and Game Updates

Your system configuration is independent of any individual game's performance. If a game update, Windows update, driver update, BIOS update, or third-party software change affects performance, this is outside our control and is not treated as a fault of the consultation.

12. Refusal of Service

We reserve the right to refuse service, stop a session, or cancel an order if we determine that a request is unsuitable, unsafe, abusive, fraudulent, outside our service scope, or not achievable on the described hardware. If we cancel before the consultation begins, we will refund the full amount paid. If we stop a session after work has begun because of abusive, fraudulent, unsafe, or materially misleading customer conduct, refunds are handled in accordance with applicable law and the proportionate-payment rules in these Terms.

13. Limitation of Liability

To the fullest extent permitted by applicable law, FPSHEAVEN shall not be liable for any indirect, incidental, or consequential damages, or for loss of data, arising from your use of the Services. Nothing in these Terms limits any rights you have as a consumer that cannot be excluded under applicable law. Our total liability is limited to the amount you paid for the relevant service.

14. Governing Law

These Terms are governed by the laws of Bulgaria, without prejudice to any mandatory consumer-protection rights available to you in your country of residence.
